Terms of Service

These Terms of Service ("Terms") govern your use of the FreeToolVault website located at freetoolvault.com ("Service"), operated by Emmanuel Nyoni ("we", "us", "our") in Johannesburg, South Africa. By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing and using FreeToolVault, you accept and agree to these Terms in full. If you disagree with any part of these Terms, you must not use the Service.

2. Description of Service

FreeToolVault provides a free collection of browser-based productivity tools including PDF tools, image tools, business document generators, and developer utilities. All tools are provided free of charge and process files locally in your browser. No file processing occurs on FreeToolVault servers.

3. Acceptable Use

You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of others. You must not:

  • Use the Service to process files containing illegal content
  • Attempt to circumvent, disable, or interfere with security-related features of the Service
  • Use automated scripts or bots to access or scrape the Service in a manner that imposes unreasonable load
  • Attempt to gain unauthorised access to any part of the Service or its related systems
  • Use the Service to violate any applicable law or regulation, including POPIA, GDPR, or the Electronic Communications and Transactions Act (ECTA)
  • Reproduce, duplicate, copy, or exploit any portion of the Service without prior written permission

4. Intellectual Property

The FreeToolVault website, including its design, text, graphics, and code (excluding third-party libraries), is the intellectual property of Emmanuel Nyoni. The following open-source libraries are used under their respective licences:

  • pdf-lib — MIT Licence
  • qrcode.js — MIT Licence

You may not copy, reproduce, or distribute any part of the FreeToolVault website without express written permission.

5. User-Generated Content and Files

All files you process using FreeToolVault tools remain entirely on your device. We do not receive, store, or have access to any file you process. You retain full ownership and responsibility for any files you work with. You warrant that you have the legal right to process any files you upload to the tools.

6. Disclaimer of Warranties

The Service is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that:

  • The Service will be uninterrupted, error-free, or free from viruses
  • The results obtained from the tools will be accurate, complete, or suitable for any particular purpose
  • Any errors in the Service will be corrected

You use the Service at your own risk. FreeToolVault tools are provided for general productivity purposes. Critical documents (legal, financial, medical) should always be reviewed by qualified professionals before use.

7. Limitation of Liability

To the maximum extent permitted by applicable South African law, Emmanuel Nyoni and FreeToolVault shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of, or inability to use, the Service. This includes loss of data, loss of profit, or loss of business opportunity.

8. Indemnification

You agree to indemnify and hold harmless Emmanuel Nyoni, FreeToolVault, and their respective affiliates from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from: your use of the Service; your violation of these Terms; or your violation of any third-party rights.

9. Third-Party Services and Links

FreeToolVault uses Google AdSense for advertising. By using the Service, you acknowledge that Google may place cookies on your device. FreeToolVault is not responsible for the privacy practices or content of any third-party services linked from or embedded in the Service.

10. Advertising

FreeToolVault is funded by advertising through Google AdSense. Advertisements displayed on the Service are served by Google and are subject to Google's advertising policies. FreeToolVault does not endorse the products or services advertised. You may opt out of personalised advertising through Google's Ad Settings.

11. Availability and Modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time without notice. We may also modify these Terms at any time. Continued use of the Service after modifications constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of South Africa. Specifically, the Consumer Protection Act 68 of 2008, Electronic Communications and Transactions Act 25 of 2002, and Protection of Personal Information Act 4 of 2013 apply to these Terms where relevant.
